Another Catholic diocese is attempting to shield its assets from lawsuits stemming from sexual abuse perpetrated by its priests by filing for bankruptcy.
The Archdiocese of Santa Fe New Mexico has been defending lawsuits over the last several years but in a recent press conference indicated that it intends to file for bankruptcy.
Historically, bankruptcy has been a process of last resort for religious entities, but it has become increasingly common as a strategy.
In our experience and observation, the Catholic church has used the bankruptcy process to shuffle and hide assets, as well as cut off future exposure for sexual abuse claims.
However, if done properly, the bankruptcy process can be an orderly way for abuse survivors to come forward, present their claim, tell their story of abuse, and receive compensation for the abuse they suffered.
